The Most Important Thing to Know About Freelance Platforms: Who Owns the IP?

And how most freelancers are leaving money on the table

If you work on Upwork, Fiverr, or any freelance platform, you might think the most important question is how do you get paid? Wrong.

The real question is:
Who actually owns what you create?

Let’s talk about intellectual property (IP), the invisible force behind any creative business.

IP Basics Every Freelancer Should Know

“Work for Hire”

This is basically legalese for “you no longer own your own work”.
When you agree to work for hire, you’re saying:

“Once I’m paid, you (the client) own it entirely, forever, as if you made it yourself.”

This means no reusing, no reselling, no posting it in your portfolio without permission. Total transfer.


Licensing Contracts

A licensing agreement is what separates broke freelancers from sustainable ones. You’re not selling the art (illustration, photo, copy, template etc), you’re renting the rights to use it.

You can define the license by:

  • Duration (e.g. 1 year, 3 years)

  • Territory (EU only vs. worldwide)

  • Media (print, digital, merch, etc.)

  • Exclusivity (exclusive or non-exclusive)

Each of these is an upsell opportunity.
You’re not adding extra work, you’re adding extra value.


NDAs (Non-Disclosure Agreements)

Clients sometimes ask for NDAs, especially if you’re working on pre-launch projects or internal materials.
Always read the fine print NDAs should protect both sides, not just silence you forever.

And yes, even an NDA can be an upsell.
It’s called a “loss of opportunity” fee — because if you can’t share or promote the work publicly, you’re losing marketing value. Clients know this, and many expect to pay a little extra for that confidentiality.

So next time a client says, “We’ll need you to sign an NDA,” you can confidently say,

“Of course! Just note that NDAs include a small confidentiality fee since I won’t be able to use the work for my portfolio.”

Professional. Polite. Profitable. 💅


How This Impacts Pricing

Here’s the magic formula:

Price = Usage × Exposure × Ownership

You can make more money just by asking, “How do you plan to use this?”

Example:

  • Personal use illustration → $200

  • Social media use → $500

  • Global campaign with print rights → $1500+

Same asset. Different rights. Different income bracket.

Most freelancers undercharge because they give away rights they didn’t know they could charge for.
